By placing an order with Rose Party Rental, the customer agrees to the following Terms and Conditions governing all rentals, services and transactions.
1. Rental Orders and Reservations
- All orders are subject to availability
- Reservations are confirmed only upon receipt of a deposit.
- Rose Party Rental reserves the right to substitute similar items of equal or greater value if necessary.
2. Payment Terms
- A deposit of 30% is required to secure booking.
- Full payment must be made upon delivery.
- We accept cash and card only.
- If full payment is not made upon delivery, Rose Part Rental reserves the right to cancel order. Deposit will not be refunded.
- All charges are subject to the federal, state and local taxes, if any. Buyer shall pay such taxes imposed on this order, and all penalties and interest, if any, accrued therewith.
3. Cancellation and Refund Policy
- Cancellations made 7 days before the event are entitled to a full refund.
- Cancellations made within the 7 days prior to the event are entitled to a 70% refund.
- Weather-related cancellations may be handled at the Rose Party Rental's discretion.
4. Delivery, Setup and Pickup
- Delivery and pickup times will be scheduled in advance.
- The Client must ensure clear access to the setup area.
- Additional fees may apply for stairs, long carry distances, difficult access or delays caused by the client.
- The Client is responsible for being present or providing access at the agreed time. Failure to do so may result in cancellation.
5. Use of Equipment
- All rental items must be used properly and for their intended purpose only.
- The Client agrees not to overload equipment, move equipment without permission or use items in unsafe conditions.
- Tents must not be used in severe weather conditions without proper safety measures.
6. Responsibility and Damages
- The Client assumes full responsibility for all rented items from delivery until pickup.
- The Client is liable for: lost, stolen or damaged items; cleaning fees for excessively dirty items; and repair or replacement costs.
7. Site Preparation
- The Client must ensure the setup area is level and suitable for installation and free of obstacles.
8. Weather Policy
- Rose Party Rental is not responsible for weather conditions affecting the event.
- It is the Client's responsibility to monitor weather and make necessary arrangements.
- Full refunds will be issued under severe weather conditions.
9. Liability Waiver
- Rose Party Rental is not liable for: injuries or accidents involving rented equipment; and damage to property caused by misuse of equipment.
- The Client agrees to indemnify and hold harmless Rose Party Rental any claims, damages, or liabilities arising from use of rental items.
10. Permits and Regulations
- The Client is responsible for obtaining any required permits.
- The Client must comply with all local laws and regulations.
11. Equipment Condition
- All equipment is inspected prior to delivery.
- The Client must notify Rose Party Rental immediately of any issues upon delivery.
12. Subcontracting
Rose Party Rental reserves the right to subcontract services (delivery, setup, etc.) when necessary.
13. Force Majeure
The Company shall not be held responsible for failure or delay due to events beyond its control, including but not limited to:
- Natural disasters
- Government restrictions
- Labor disputes
- Transportation issues
14. Governing Law
These Terms shall be governed by the laws of the State of New York.
15. Changes to Terms
Rose Party Rental reserves the right to update these Terms at any time. The latest version will apply to all bookings.
